Stephen practices in the areas of construction litigation, insurance coverage, and pharmaceutical regulatory compliance. He is an experienced litigator who has presented cases in court and arbitration and has successfully argued before the United States Court of Appeals for the Eleventh Circuit. Stephen was honored as a Rising Star in 2012, 2013, 2014, and 2015 by Law & Politics and the publishers of Atlanta Magazine’s Georgia Super Lawyers.
Stephen graduated from Brigham Young University with a degree in Public Relations and a double-minor in Business and Korean. He earned his law degree from Temple University where, as a member of Temple’s National Trial Team, he was a champion of the 2004 Buffalo Invitational National Trial Competition, a runner-up at the 2005 ATLA Regional Trial Competition, and a recipient of a Best Advocate Award at the 2003 Cathy Bennett National Criminal Trial Competition. Stephen was also a recipient of Temple’s Class of 2005 Most Promising Litigator Award and its Class of 2005 Excellence in Trial Advocacy Award.
Stephen is active outside of the legal profession. He was a catcher for the Brigham Young University baseball team from 1996 to 2001 and was named a 2000-2001 Mountain West Conference Baseball Scholar Athlete of the Year. In addition, Stephen served a 2-year mission in Taejon, Korea, and is conversant in Korean. Stephen lives in Kennesaw with his wife, Amber, and their three children.
Stephen has extensive experience litigating commercial and residential construction defect claims, construction accidents, federal Clean Water Act claims, and other storm water related state law claims. Stephen has represented owners, general contractors, subcontractors, subdivision developers, and industry professionals in litigation matters relating to high-rise condominium and apartment buildings, parking decks, mixed-use developments, residential subdivisions, multi-million dollar custom homes, and modest single-family residences. Stephen’s construction practice also involves assisting clients with commercial/transactional matters, including drafting, reviewing, and litigating contracts, subcontracts, lease agreements, and termination agreements, as well as assisting clients in performing risk analyses.
Stephen is active in the commercial general liability insurance industry and has served as coverage counsel to several national insurance carriers. In addition to providing coverage opinions, drafting reservation of rights letters, and representing insurers’ interests at mediations and in coverage litigation, Stephen also provides risk management services to insurers and assists them in drafting and revising manuscript policy endorsements that are used throughout the country. Stephen also utilizes his insurance coverage expertise on behalf of his construction clients in litigating third-party claims against potentially liable subcontractors, non-parties, and their insurers.
Pharmaceutical Regulatory Compliance
Stephen is a consultant for retail, compounding, and health-system pharmacies and advises clients on matters related to compliance with state and federal regulations governing 503(A) compounding pharmacies and 503(B) outsourcing facilities. Stephen specializes in assisting pharmacies in preparing for and responding to FDA inspections and also represents clients in state board of pharmacy matters.
